What is a service charge demand?

Where landlords have obligations to provide services to the leaseholders in a building, the leases will require the leaseholders to pay contributions to the landlord. There are many chargeable items which fall within the parameters of a service charge including insurance, maintenance, management fees, utilities, gardening, cleaning and more. Under the Landlord and Tenant Act 1985, service charge contributions should be demanded with a Section 18 Notice. This is the correct method to request and enforce contributions.

Failure to follow the correct procedures could jeopardise the landlord’s ability to collect contributions. Leaseholders may argue that services charges are not payable unless properly demanded.
